1. Definitions

“LayerMix Academy,” “we,” “us,” and “our” refer to the provider of the Services. “You” refers to any user, visitor, or customer.

  • “Services” means our websites, learning materials, courses, community areas, and related features.
  • “Content” means text, videos, downloads, templates, assignments, and other materials made available through the Services.
  • “User Content” means material you submit, upload, post, or otherwise provide to the Services.

2. Acceptance of Terms

By accessing or using the Services, you agree to these Terms and any additional terms presented within the Services (for example, specific course rules or community guidelines). If you do not agree, do not use the Services.

Where permitted by law, you also agree that electronic acceptance (including clicking an “agree” button, continuing to use the Services, or creating an account) has the same effect as a written signature.


3. Eligibility

You must be legally capable of entering into a binding agreement in your jurisdiction. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.

4. Accounts & Security

  • Account accuracy. You agree to provide accurate, current information and to keep it updated.
  • Security. You are responsible for maintaining the confidentiality of your login credentials and for activity under your account.
  • Unauthorized use. You must notify us promptly if you suspect unauthorized access or misuse.
  • Account sharing. Unless explicitly permitted in writing, you may not share accounts, resell access, or provide logins to others.

5. Services

We may offer learning experiences including self-paced courses, live sessions, downloadable resources, and community participation. Services may evolve over time.

  • Availability. We aim for reliable access but do not guarantee uninterrupted operation.
  • Updates. Content may be updated, improved, replaced, or discontinued.
  • Access windows. Some offerings may be time-limited or subject to expiration as stated at purchase.

6. Pricing & Payments

Prices, taxes, and billing terms are displayed at checkout or within the Services at the time of purchase. By submitting payment, you authorize us (and our payment processors) to charge the provided payment method.

  • Taxes. You are responsible for any applicable taxes unless stated otherwise.
  • Currency. Transactions may be processed in the currency shown at checkout.
  • Chargebacks. If you initiate a chargeback without first contacting us to resolve a billing issue, we may suspend access while we investigate.

7. Refunds & Cancellations

Refund eligibility depends on the type of offering and the timing of your request. Unless local consumer laws require otherwise:

  • Digital content. Once a digital download is accessed or a course is substantially consumed, refunds may be denied.
  • Subscriptions. Subscription cancellations prevent future renewals; previously paid periods are generally non-refundable.
  • Live cohorts. Refund policies for cohort-based programs may include strict cutoffs due to limited seats and scheduling.

8. License & Intellectual Property

The Services and Content are owned by LayerMix Academy or its licensors and are protected by intellectual property laws.

  • Personal license. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Content for your personal, non-commercial learning.
  • Restrictions. You may not copy, reproduce, distribute, publicly perform, create derivative works, scrape, or re-sell the Content unless permitted in writing.
  • Brand. “LayerMix Academy” names, logos, and related marks may not be used without permission.

9. User Content

You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your User Content solely as needed to operate, improve, and provide the Services.

  • Permissions. You confirm you have the rights to submit your User Content.
  • Moderation. We may remove User Content that violates these Terms or applicable law.
  • Feedback. If you submit suggestions, you grant us the right to use them without restriction or compensation.

10. Acceptable Use

You agree not to misuse the Services. Prohibited conduct includes:

  • Attempting to access non-public areas or systems without authorization.
  • Interfering with or disrupting the Services, including rate-limiting evasion or DDoS attempts.
  • Uploading malware, harmful code, or content designed to compromise security.
  • Harassment, hate speech, doxxing, or unlawful discrimination.
  • Infringing intellectual property rights or violating privacy rights.
  • Using the Services for illegal activity or to promote illegal activity.
  • Automated scraping or data harvesting without permission.

We may suspend or terminate access for violations and may cooperate with lawful requests from authorities where required.


11. Third-Party Services

The Services may link to or integrate with third-party tools (e.g., video hosting, payment processors, analytics). We are not responsible for third-party services, and your use of them may be governed by their own terms and policies.


12. Disclaimers

To the maximum extent permitted by law, the Services and Content are provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory.

  • No guarantee of outcomes. Educational content is for learning purposes; results depend on many factors and are not guaranteed.
  • Technical issues. We do not warrant that the Services will be uninterrupted, secure, or error-free.

13. Limitation of Liability

To the maximum extent permitted by law, LayerMix Academy will not be liable for indirect, incidental, consequential, special, or punitive damages, or any loss of profits, data, goodwill, or business interruption arising from or relating to the Services.

Where liability cannot be excluded, our total liability for all claims will be limited to the amount you paid to us for the Services giving rise to the claim during the 3 months before the event that resulted in the claim.


14. Indemnity

You agree to defend, indemnify, and hold harmless LayerMix Academy and its affiliates, officers, employees, contractors, and licensors from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your User Content, or your violation of these Terms.


15. Termination

We may suspend or terminate your access to the Services at any time if we reasonably believe you violated these Terms, or if required by law.

You may stop using the Services at any time. Sections intended to survive termination (including licensing restrictions, disclaimers, limitation of liability, and indemnity) will survive.


16. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date reflects the latest revision. If changes are material, we may provide additional notice as required by law.

Your continued use of the Services after updates become effective constitutes acceptance of the updated Terms.


17. Privacy

We respect privacy and handle personal data according to applicable laws and our privacy practices presented within the Services. Where required, you will be asked for consent before non-essential cookies are used.


18. Governing Law & Dispute Resolution

These Terms are intended to be globally applicable. If your local consumer laws provide mandatory protections, they apply and prevail where required.

Unless prohibited by applicable law, disputes will be resolved in a competent court with jurisdiction over the provider, and the governing law will be the law of that jurisdiction.
